El presente documento regula los términos y condiciones generales (en adelante "TÉRMINOS Y CONDICIONES") aplicables al uso de los contenidos, productos y servicios ofrecidos a través del sitio web www.csipi.org (en adelante "SITIO WEB"), cuyo titular es el CLÚSTER DE SEGURIDAD INDUSTRIAL, PROTECCIÓN E INTELIGENCIA DE BAJA CALIFORNIA, A.C. (en adelante "TITULAR"), con domicilio establecido en Baja California.
Se considera "USUARIO" a toda persona que acceda, navegue o utilice de cualquier forma el SITIO WEB.
Toda persona que pretenda acceder o utilizar el SITIO WEB y los servicios ofrecidos en él, podrá hacerlo únicamente sujeto a los TÉRMINOS Y CONDICIONES aquí establecidos, así como a las políticas y principios incorporados en el presente documento. En todo caso, aquella persona que no acepte los TÉRMINOS Y CONDICIONES vigentes, deberá abstenerse de utilizar el SITIO WEB y/o adquirir los productos y servicios que eventualmente sean ofrecidos en el mismo.
1. SCOPE AND CONDITIONS OF ACCESS
The purpose of these TERMS AND CONDITIONS is to regulate access to and use of the WEBSITE, including any type of content, product, or service made available to the general public within the domain www.csipi.org.
The DATA CONTROLLER expressly reserves the right to make modifications at any time and without prior notice to the appearance, content, functionality, products, services, and configuration that may be contained on the WEBSITE. Accordingly, the USER acknowledges and agrees that the DATA CONTROLLER may, at any time, interrupt, disable, or discontinue any of the elements comprising the WEBSITE, or access thereto.
Access to the WEBSITE by the USER is provided freely and, in general, at no cost, without the USER being required to provide any payment or consideration to use it, except for the cost of the internet connection contracted by the USER with their internet service provider.
Access to certain content and services of the WEBSITE may require prior subscription or registration by the USER.
The WEBSITE has been designed primarily to meet the needs of USERS residing in Mexico. The DATA CONTROLLER cannot guarantee that the WEBSITE complies with all laws and regulations of countries outside Mexico. If a USER resides in another country and chooses to access or use the WEBSITE, they do so at their own risk and responsibility and must ensure that such access and use comply with the local laws and regulations applicable to them. The DATA CONTROLLER assumes no responsibility for any legal consequences that may arise from accessing or using the WEBSITE from locations outside Mexico.
The DATA CONTROLLER may choose to administer and manage the WEBSITE directly or through an authorized third party. This decision shall not affect the TERMS AND CONDITIONS established herein nor modify the rights and responsibilities agreed upon between the USER and the DATA CONTROLLER.
2. USER AND USE OF THE WEBSITE
Access to or use of the WEBSITE confers the status of USER. By interacting with the website’s resources, such as posts or comments, the USER agrees to be bound by these TERMS AND CONDITIONS, including any amendments thereto. Acceptance is deemed to occur from the moment the USER accesses the WEBSITE; therefore, USERS are advised to review these terms periodically for updates.
The USER assumes responsibility for using the WEBSITE in accordance with its design and intended purpose. The use of any type of software that automates interaction with or the downloading of content is strictly prohibited. The USER agrees to use the information, content, and services lawfully and in compliance with these TERMS AND CONDITIONS, as well as applicable standards of morality and public order. The USER shall refrain from engaging in any activity that may infringe upon the rights of third parties or impair the operation of the WEBSITE.
The DATA CONTROLLER reserves the right to remove comments and contributions that violate the law, infringe upon the dignity of individuals, are discriminatory, affect the rights of third parties, contravene public order, or are otherwise unsuitable for publication.
Under no circumstances shall the DATA CONTROLLER be held responsible for opinions expressed by USERS through comments or publications.
Access to the WEBSITE does not imply the establishment of any type of relationship between the DATA CONTROLLER and the USER.
3. ACCESS TO AND NAVIGATION OF THE WEBSITE
The DATA CONTROLLER cannot absolutely guarantee the continuity and availability of the content, products, or services provided through the WEBSITE, although it will make reasonable efforts to ensure its proper operation. This shall not imply any liability on the part of the DATA CONTROLLER.
The USER is responsible for using the WEBSITE appropriately and in compliance with these TERMS AND CONDITIONS and applicable laws and regulations. Any improper use shall be the sole responsibility of the USER.
The USER assumes full responsibility for any consequences arising from their interaction with the WEBSITE and its content.
4. PRIVACY AND DATA PROTECTION NOTICE
In strict compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, the DATA CONTROLLER is committed to implementing the necessary measures to ensure the privacy and security of the information collected, preventing its alteration, loss, or unauthorized use.
All Personal Data collected through the WEBSITE shall be processed in strict accordance with the principles of lawfulness, data quality, purpose limitation, fair processing, and accountability. The processing of such data shall be subject to the prior consent of its owner. In particular, the use of financial or asset-related data shall require express authorization, which may be granted through the mechanisms provided on the WEBSITE, ensuring the appropriate protection of such information. The same shall apply to the processing of sensitive Personal Data, understood as data that, if improperly used, could result in discrimination or pose a risk to the data subject.
At all times, Personal Data stored in databases shall be kept accurate, up to date, and appropriate for the specific purposes for which it was collected.
The use of Personal Data shall be limited to the purposes established in the PRIVACY NOTICE, which shall be available at the following electronic address: PRIVACY NOTICE.
The WEBSITE may contain hyperlinks or links that redirect users to third-party websites. These websites have their own privacy notices; therefore, the DATA CONTROLLER shall not be responsible for any information provided by the USER on websites other than the WEBSITE.
The DATA CONTROLLER reserves the right to modify its PRIVACY NOTICE as necessary. By accessing or using the WEBSITE after such modifications, the USER accepts the changes made.
Access to the WEBSITE may involve the use of Cookies, which are small amounts of information stored in the USER's browser. These Cookies facilitate navigation and improve the user experience. If the USER does not wish for this type of information to be collected, they may disable or reject the use of Cookies through their browser settings.
5. LINKS AND EXTERNAL CONTENT ON THE WEBSITE

Therefore, the availability, accuracy, or truthfulness of such websites cannot be guaranteed. The DATA CONTROLLER assumes no responsibility for any damages or losses that may arise from accessing or using content on websites not managed by the DATA CONTROLLER.
USERS or third parties wishing to publish a link to this WEBSITE from an external webpage must be aware that the full or partial reproduction of the WEBSITE's content without the express authorization of the DATA CONTROLLER is prohibited. The establishment of a link does not imply the existence of any relationship between the DATA CONTROLLER and the external website.
6. PROTECTION OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The WEBSITE, including its source code, images, audio or video files, logos, trademarks, designs, and other elements, are owned by the DATA CONTROLLER or have been licensed or assigned to it, and are protected under Mexican and international intellectual property laws. The reproduction, distribution, or dissemination of the WEBSITE's content for commercial purposes is strictly prohibited without the prior express authorization of the DATA CONTROLLER.
The USER agrees to respect the intellectual property rights of the DATA CONTROLLER. However, the USER is permitted to view, print, copy, or store elements of the WEBSITE exclusively for personal use.
The USER agrees not to remove, alter, or manipulate any element, file, or content of the WEBSITE. The USER shall also refrain from taking any action that may compromise the security of protected files or databases.
If the USER or any third party believes that any content infringes upon their intellectual property rights, they must immediately notify the DATA CONTROLLER via email at info@csipi.org.
7. DISCLAIMER OF LIABILITY FOR ERRORS AND INACCURACIES
The USER acknowledges and agrees that the WEBSITE and its services may contain typographical errors, inaccuracies, or omissions in descriptions.
The DATA CONTROLLER reserves the right to correct any errors, inaccuracies, or omissions without prior notice and to modify or update the information.
The USER understands that the DATA CONTROLLER is not obligated to update, modify, or clarify the information, except when required by law.
8. PROHIBITIONS ON USE OF THE WEBSITE
The USER acknowledges and agrees that it is strictly prohibited to use the WEBSITE and its content to:

The USER understands and agrees that, in the event of a violation of any of these prohibitions, the DATA CONTROLLER reserves the right to terminate the USER's access to and use of the service without prior notice.
9. LIMITATION OF LIABILITY
The DATA CONTROLLER, as well as its President, Vice President, members of the Board of Directors, members of the Strategic Security and Intelligence Committee, Foreign Investment Manufacturing Commission, members of the Security Cluster, affiliates, contractors, or suppliers, shall not assume any liability for injuries, losses, claims, or damages of any kind, whether direct, indirect, incidental, punitive, special, or consequential. This limitation of liability includes, but is not limited to, loss of profits, data, or any other similar damages.
The DATA CONTROLLER's liability arising from the use of its services or products is not limited solely to such use but extends to any other related claim, including any errors or omissions in the content, as well as any loss or damage that the USER may experience.
It is important to note that in certain jurisdictions, the exclusion or limitation of liability may not be permitted. In such cases, liability shall be limited to the maximum extent permitted by applicable law.
10. INDEMNIFICATION
The USER agrees to indemnify, defend, and hold harmless the DATA CONTROLLER, as well as its President, Vice President, members of the Board of Directors, members of the Strategic Security and Intelligence Committee, the Foreign Investment Manufacturing Commission, members of the Security Cluster, and affiliates, from and against any third-party claims or demands, including reasonable attorneys’ fees, arising from the USER's breach of these TERMS AND CONDITIONS or any violation of applicable laws or third-party rights.
11. APPLICABLE LAW AND JURISDICTION
The DATA CONTROLLER reserves the right to take any necessary legal action in the event of improper use of the WEBSITE or any breach of these TERMS AND CONDITIONS.
The relationship between the USER and the DATA CONTROLLER shall be governed by the laws in force in Mexico, specifically those applicable in the city of Tijuana, Baja California. Any dispute arising between the parties shall be submitted to the jurisdiction of the competent courts in said city.
12. NULIDAD E INEFICACIA DE LAS CLÁUSULAS
Si alguna cláusula de estos TÉRMINOS Y CONDICIONES es declarada nula o ineficaz, dicha declaración afectará únicamente a esa disposición, manteniéndose vigentes los demás TÉRMINOS Y CONDICIONES. La cláusula afectada se considerará como no escrita.
